Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you", "user") and PhotoReel ("PhotoReel", "we", "us") regarding your use of photoreel.app (the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

PhotoReel is an AI-powered video generation tool. You provide inputs (a text prompt, a reference photo, etc.) and receive a generated video. Output is probabilistic and we do not guarantee any particular result.

2. Accounts

  • You must be at least 13 years old (or the minimum age for digital consent in your jurisdiction, whichever is higher) to create an account.
  • You are responsible for the security of your account and for all activity that takes place under it.
  • Sharing, reselling, or operating accounts on behalf of third parties without our written consent is not permitted.

3. Acceptable Use

You agree not to use the Service to:

  • Generate content that sexually depicts, exploits, or endangers minors in any form — this is a zero-tolerance category and will trigger immediate termination and reporting to NCMEC / local authorities.
  • Generate non-consensual intimate imagery of any real person, or content that identifiably impersonates a real person without their explicit consent (including "deepfakes" of public figures, coworkers, or ex- partners).
  • Generate content that incites violence, harassment, hatred, or discrimination against a person or group based on protected characteristics.
  • Generate content that infringes on another party's copyright, trademark, right of publicity, or other intellectual property rights.
  • Generate content for fraud, misinformation / political disinformation, spam, phishing, or malware distribution.
  • Attempt to reverse-engineer the Service, probe for vulnerabilities, scrape its APIs outside the official interface, or otherwise interfere with its operation.

We may remove content and suspend or terminate accounts that violate this section, at our discretion and without prior notice when the violation is serious (e.g. CSAM). Credits spent on removed content are not refunded when the removal is due to an Acceptable Use violation.

4. Your Content

You retain ownership of all inputs you upload ("User Content") and all videos generated from them ("Output"). You grant PhotoReel a limited, non-exclusive, royalty-free license to store, process, reproduce, and transmit your User Content and Output solely to the extent needed to (a) run the video generation, (b) deliver the Output back to you, and (c) store it for as long as required by our Privacy Policy. This license ends when we delete the content (see retention policy in the Privacy Policy).

You are solely responsible for your User Content — you represent that you own it or have the rights needed to upload and use it. If a third party claims your User Content infringes their rights, you agree to respond to our DMCA / takedown notice procedure in good faith.

5. Credits, Subscriptions & Payments

  • Generation consumes credits. Credits can be purchased as one-time top-ups or as part of a subscription plan.
  • Subscription plans auto-renew at the end of each billing period. You can cancel renewal at any time from the billing page; cancellation takes effect at the end of the current period.
  • Failed generations caused by a system error on our side (infrastructure failure, upstream provider outage) are automatically credit-refunded. You do not need to open a ticket for these.

  • Prices may change; material changes to subscription pricing will be communicated at least 14 days before they take effect on your account.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, that generation quality will meet your expectations, or that defects will be corrected.

7. Limitation of Liability

To the maximum extent permitted by law, PhotoReel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangibles, arising out of or related to your use of the Service. Our aggregate liability to you for any claim arising out of these Terms is limited to the amounts you actually paid to us in the twelve (12) months preceding the event giving rise to the claim, or US$100 if you paid nothing.

8. Independence Statement

PhotoReel is an independent service. We are not affiliated with, endorsed by, sponsored by, or a reseller of any upstream AI model provider, and we do not represent the views of any such provider. Model names that may appear in technical documentation (e.g. API request logs) are used solely to identify the inference engine we use behind the scenes; any third-party trademarks are the property of their respective owners.

9. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if the Service is discontinued. On termination, your rights under these Terms end; sections that by their nature should survive (ownership, disclaimers, liability, governing law) will survive.

10. Governing Law

These Terms are governed by the laws of the jurisdiction in which PhotoReel is established, without regard to conflict-of-laws principles. Where mandatory local law grants you stronger consumer rights, those rights prevail over anything in these Terms.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in-product or by email at least 14 days before they take effect. Continued use of the Service after that period constitutes acceptance of the updated Terms.
